The terms governing your use of meaningstack.com and kamiraflow.com.
These Website Terms of Use govern your access to and use of meaningstack.com and kamiraflow.com. Use of the KamiraFlow and Steward applications and related services are governed by separate Application Terms of Service. Please read these carefully — by using either website, you agree to them.
Who We Are
These Website Terms of Use (the "Terms") are a binding agreement between you and MeaningStack B.V., a Dutch private limited company registered with the Dutch Chamber of Commerce under number KvK 42064215, with registered office at Papenweg 18, 6212 CG, Maastricht, the Netherlands ("MeaningStack," "we," "us," "our"). We operate the websites at meaningstack.com and kamiraflow.com (the "Websites") and our products and services, which include the KamiraFlow product, the Steward product, and any other MeaningStack products and services offered from time to time (together, the "Services").
Acceptance of These Terms
By accessing or using either Website, you agree to these Terms. If you do not agree, do not use the Websites. If you are accessing the Websites on behalf of an organization, you represent that you have authority to bind that organization.
The Websites and Their Content
The Websites provide information about MeaningStack and the Services, including marketing content, documentation, articles, contact forms, and links to the applications. Use of the Services (including the KamiraFlow and Steward applications) is governed by separate Application Terms of Service for each product, and by our Data Processing Agreement where we process customer personal data, each incorporated by reference and applicable when you access the relevant Service.
We may suspend, withdraw, discontinue, or change all or any part of the Websites or the Services without notice, and we are under no obligation to ensure the Websites remain available or uninterrupted.
Permitted and Prohibited Use
You may access and view the Websites for lawful personal or business informational purposes. You may not, and may not permit any third party to:
- Reproduce, distribute, modify, or create derivative works from Website content except as expressly permitted or allowed under applicable mandatory law;
- Use automated means (bots, scrapers, crawlers) to access the Websites for mass data collection, except for legitimate search-engine indexing operating in accordance with our robots.txt;
- Reverse-engineer, decompile, or attempt to derive the source code of any software made available through the Websites, except to the extent such restriction is prohibited by applicable mandatory law;
- Use the Websites to transmit unlawful, harmful, infringing, or harassing material;
- Use the Websites or their content to develop, train, or improve any artificial intelligence model, or to compile content for use as training data — including for purposes of text and data mining, dataset creation, retrieval-augmentation corpora, or machine-learning training — without our prior written authorisation. This restriction is asserted on the basis of our copyright and database rights in the Website content and constitutes an express reservation against text and data mining under Article 4 of Directive (EU) 2019/790;
- Misrepresent your identity or affiliation;
- Attempt to gain unauthorized access to any portion of the Websites.
Intellectual Property
The Websites, the Services, and their content (text, graphics, logos, images, software, and the “MeaningStack”, “Steward”, and “KamiraFlow” names and marks) are owned by MeaningStack B.V. or its licensors and are protected by intellectual-property laws. Certain patent-pending technology underlying the KamiraFlow and Steward products is currently owned by MeaningStack’s founder, Luciana Ledesma, and made available to MeaningStack for use in the Services. MeaningStack and its founder intend to consolidate this technology under Inner Edge B.V. as an intellectual-property holding company, after which it will be licensed to MeaningStack B.V. Nothing in these Terms grants you any right, title, or interest other than the limited right to access and view the Websites in accordance with these Terms. All rights not expressly granted are reserved.
User Submissions
If you submit comments, feedback, or suggestions through the Websites, you grant MeaningStack a worldwide, royalty-free, perpetual license to use, reproduce, modify, and incorporate such feedback and suggestions into our products, services, and operations.
This license applies to ideas and feedback only. It does not extend to any personal data contained in a submission. Personal data you provide is handled solely in accordance with our Privacy Policy, and your statutory rights under the GDPR (including access, rectification, erasure, restriction, objection, and portability) continue to apply and override this license to the extent of any conflict. Please do not submit confidential information or special-category personal data through the Websites.
Third-Party Links and Services
The Websites may link to or embed third-party services (for example, web forms hosted by our processors). MeaningStack does not control and is not responsible for third-party content. Your use of any third-party website is at your own risk and subject to that website's terms. Third-party processors that handle personal data on our behalf are listed in our Privacy Policy.
Disclaimers
Except where prohibited by applicable mandatory law, the Websites are provided "as is" and "as available," without warranty of any kind. Information on the Websites, including descriptions of products, capabilities, and roadmap, is for general informational purposes and may change without notice.
Limitation of Liability
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable mandatory law, including liability under the GDPR.
Subject to the foregoing, and in relation to your use of the Websites (as distinct from paid use of the Services, which is governed by the applicable application terms), MeaningStack shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, and MeaningStack's total cumulative liability arising out of your use of the Websites shall not exceed EUR 350.
Commercial liability in connection with paid use of the Services (including the KamiraFlow and Steward applications) is addressed separately in the applicable Application Terms of Service and/or Master Services Agreement.
Privacy
Our processing of personal data in connection with the Websites is described in our Privacy Policy, incorporated by reference.
Changes
We may update these Terms from time to time. The current version is always posted with the "Last updated" date. Continued use after a change becomes effective constitutes acceptance.
Governing Law and Disputes
These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, except where mandatory consumer law provides otherwise. The foregoing does not limit mandatory consumer-protection rights you may have in your country of residence.
